The appellant seeks pre-arrest bail in connection with Shikarpur P.S. Case No. 382 of 2019 registered under Sections 147, 148, 149, 323, 307, 379 of the Indian Penal Code and Section 3(i) (r) (w) (ii) (v-a) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Submission of learned counsel for the appellant is that similarly situated co-accused namely, Nesar Khan @ Nesar Ahmad has already been allowed bail by a Co-ordinate Bench of this Court vide Cr. Appeal (SJ) No. 1223 of 2020 on 20.02.2021. Having heard both sides and in the facts and circumstances of the case, let the above named appellant be released on bail, in the event of arrest or surrender, on

Case No. 382 of 2019, subject to the conditions as laid down under section 438(2) of Cr. P.C. Accordingly, the appeal is allowed and the impugned order dated 07.12.2019 is set aside.
