The petitioner is apprehending his arrest in connection with Mohania PS.Case No.368 of 2019 registered for offences punishable under Sections 341, 323, 324, 307, 504, 506/34 of the Indian Penal Code.

Specific allegation of firing is against the petitioner and other accused persons of causing injury to the son of the informant .

Submission of the learned counsel for the petitioner is that no fire arm injury was found on the person of the son of the informant and further submitted that as a matter of fact the son of the informant fired .

Heard learned A.P.P. who has opposed the prayer for bail on the ground that the son of the informant was taken to the

Patna High Court CR. MISC. No.1708 of 2020(2) dt.14-01-2020 2/2 BHU for his treatment and he remained there for treatment. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below on its own merit.

With the aforesaid direction, this application is dismissed.
