JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-02-2021 The present writ petition has been filed for directing the respondent- authorities to make payment of the death-cumretiral dues of the son of the petitioner, who has died in harness. The learned counsel for the State Sri Nadim Seraj, by referring to the counter affidavit filed on behalf of the respondent no. 4, has submitted that earlier, the widow of the son of the petitioner namely Late Mithlesh Kr. Sah, who had died in harness, had approached this Court by filing a writ petition bearing C.W.J.C. no. 22032 of 2019, wherein a coordinate Bench of this Court vide order dated 18.11.2019 had

Patna High Court CWJC No.2187 of 2020(4) dt.18-02-2021 2/2 directed the respondent-authorities to pay all the admitted outstanding retiral dues to the widow namely Priyanka Kumari, who is the daughter-in-law of the petitioner herein and accordingly, all the death-cum-retiral benefits have already stood paid to the widow of the deceased son of the petitioner, hence it is submitted that there is no merit in the present petition.

The learned counsel for the Accountant General Sri Kumar Priya Ranjan has also submitted that all the retiral benefits have stood paid to the widow of the deceased son of the petitioner.

At this juncture, the learned counsel for the State has informed this Court that the amount of compensation has also been paid to the widow of the deceased son of the petitioner. Having regard to the facts and circumstances of the case, this Court does not deem it fit and appropriate to proceed any further in the matter, hence the present writ petition stands disposed off in light of the submissions made by the learned counsel for the State, as aforesaid.
