Patna High Court CR. MISC. No.87129 of 2019(2) dt.23-01-2020 2/3 offences under Sections 147, 148, 149, 447, 341, 323, 324, 307, 354 of IPC.
As per prosecution case, 12 accused persons along with petitioners came and assaulted the informant. There is specific allegation against petitioner no.6 and 7 of assault by farsa and gandasa to the son of the informant and there is also allegation against one Dhrub Yadav that he caught hold to the informant and assaulted by country made pistol and there are general allegation of assault against other accused persons also. Submission of the learned counsel for the petitioners is that there is a case and counter case between the parties. Injuries are from the petitioners side also and the injury to the son of the informant and his wife and others are simple in nature.

Having heard both sides, considering the above submissions, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Bettiah, West
