JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-01-2020 Petitioner seeks regular bail in connection with Kumarkhand P. S. Case No. 217 of 2018 registered for the offence punishable under Section 392 of the Indian Penal Code. As per prosecution case, some miscreants has dashed the vehicle of the informant from backside and when he fell down, they have taken away mobile phone, Aadhar Card, Driving License, Rs.2500/- from him as well as motorcycle. Submission of the learned counsel for the petitioner is that except confessional statement, there is nothing against him and though the mobile phone has been recovered from the petitioner, but he has taken the same from the other person. He is in custody since 03.10.2019.

Heard learned A.P.P. also, who has opposed the prayer for bail on the ground that there is recovery of looted mobile

Patna High Court CR. MISC. No.86493 of 2019(2) dt.14-01-2020 2/2 phone from the petitioner. Apart from that he is accused in two other cases also.

Having heard both sides, in view of the submissions, made above, I am not inclined to grant bail to the petitioner at this stage, With the above observations, this application is dismissed.
