2. The petitioner seeks pre-arrest bail in connection with Rajoun P.S. Case No. 389 of 2023 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 332, 337, 353, 427 and 504 of the Indian Penal Code.

3. The case of the prosecution in short is that the petitioner along with other unknown 30-35 persons have assaulted the police party and have thrown bricks on the police vehicle.

4. Learned counsel appearing on behalf of the petitioner submitted that the petitioner has been falsely implicated in connection with the present case. He also submits that the persons were identified by the chowkidar. No specific role is attributed to the petitioner. He further submits that

Patna High Court CR. MISC. No.91907 of 2025(2) dt.06-02-2026 2/2 similarly situated co-accused namely, Rahul Kumar has already been granted anticipatory bail by this Court vide Cr. Misc. No. 44947 of 2025. The case of this petitioner stands on similar footing.

5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner and submits that the petitioner is having criminal antecedent of four cases.

Considering the nature of allegation against the petitioner, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Rajoun P.S. Case No. 389 of 2023 subject to the condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
