JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2020 Petitioners seek bail in anticipation of their arrest in connection with Shikarpur P.S. Case No. 115 of 2019 registered for the offences punishable under Sections 147, 149, 341, 342, 188, 353, 504 and 506 of the Indian Penal Code. Allegation against the petitioners and other accused persons is that they created road jam by putting a dead body on the road and even after intervention of administration they did not allow the vehicles to ply on the road.

Submission of learned counsel for the petitioners is that there is general and omnibus allegation against all the accused persons and no specific allegation has been attributed

Patna High Court CR. MISC. No.87110 of 2019(2) dt.23-01-2020 2/2 against them and they have no criminal antecedent. Heard learned APP also.

In view of above facts and circumstances, let petitioners, in the event of surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, West Champaran, Bettiah, in connection with Shikarpur P.S. Case No. 115 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
