JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-02-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Piri Bazar P.S. Case No. 83 of 2014, registered for the offence punishable under Sections 341, 323, 504, 354B and 379/34 of the Indian Penal Code.

The accusation against the petitioner is that he along with other FIR named accused abused informant's wife and other family members and also tried to outrage the modesty of the informant's wife.

Submission of the petitioner is that there is land

Patna High Court CR. MISC. No.86893 of 2019(2) dt.17-02-2020 2/2 dispute between the parties and as a matter of fact a quarrel took place between the parties on the alleged date of occurrence but the informant lodged the present case with exaggerated story. Admittedly, except Sections 354B and 379 of the Indian Penal Code almost all the Sections are bailable in nature. So far as Sections 354B and 379 are concerned, the same appears to be superfluous addition.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail is allowed and it is ordered that petitioner, above named, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Piri Bazar P.S. Case No. 83 of 2014, subject to conditions as laid down under Section 438 (2) of the Cr.P.C.
