JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-01-2020 Petitioner seeks regular bail in connection with Bikram P. S. Case No.377 of 2019 registered for the offences punishable under Sections 341, 323 of IPC and Section 37(b)(c) of Bihar Prohibition & Excise Act, 2016.

As per prosecution case is an assault to the wife by the petitioner in a drunken condition.

Submission of the learned counsel for the petitioner is that allegation is false. He has been made accused at the instance of his wife and moreover, he is custody for two months and there is no chance of tempering with the evidence. Heard learned A.P.P.

Having heard both sides, in view of the submissions, made above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five

Patna High Court CR. MISC. No.87052 of 2019(2) dt.14-01-2020 2/2 Thousand) with two sureties of the like amount to the satisfaction of Special Judge Excise, Patna in connection with Bikram P. S. Case No.377 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition to co-operate in disposal of the trial.
