The petitioner seeks regular bail in connection with Bihpur (Jhandapur) P.S.case no.443 of 2019 dated 29.11.2019 registered for offences punishable under Sections 30(a), 38(i) of Bihar Prohibition and Excise Act, 2016.

There is recovery of 910 ltrs. of foreign liquor from the Pick-up Van, in which the petitioner is said to be driver. Submission of the learned counsel for the petitioner is that he has nothing to do with the seized articles and Khalasi of the Van has already been granted bail by a Co-ordinate Bench of this Court, vide order dated 20.1.2020 passed in Cr. Misc. No.353 of 2020. Petitioner is in custody since 29.11.2019. charge sheet has already been submitted.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge II cum Special Judge, Excise, Bhagalpur in connection with Bihpur (Jhandapur O.P.) P.S.case no.443 of 2019. With the above direction, this application is allowed.
