JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2020 This application, for grant of anticipatory bail, arises out of Sakri P.S. Case No. 19 of 2019, disclosing offences under Sections 406 and 420 of the Indian Penal Code. Prosecution case is that petitioner showing himself to be a recovery agent of a bank assured the informant to provide him one auctioned vehicle, on which, the informant deposited an amount of Rs. 2,45,000/- in the account of one Raushan Kumar Chaudhary but it appears neither the vehicle was given to the informant nor his money was returned.

Submission of learned counsel for the petitioner is tht from the F.I.R. itself it is evident that the money was deposited in the account of one Raushan Kumar Chaudhary and not in the account of the petitioner. Further submission is that petitioner

Patna High Court CR. MISC. No.689 of 2020(2) dt.23-01-2020 2/2 has falsely been implicated in this case and ready to abide by any condition imposed on him.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani, in connection with Sakri P.S. Case No. 19 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure with further subject to the condition that petitioner shall cooperate in investigation and appear before the police as and when required.
