The petitioner seeks bail in connection with Bahadurpur P.S. Case No. 169 of 2019 registered under Sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act, 2016. It is submitted by the learned counsel for the petitioner that the petitioner has no concern with the alleged liquor or hut in any manner. The land over which the hut is made does not belong to him. He has been implicated in the instant case only out of suspicion and dirty village politics. He is in judicial custody since 25.10.2019 and on completion of investigation, the police have already submitted charge-sheet, and, as such, there is no chance of tampering with the evidence. Learned counsel for the State while opposing the
Patna High Court CR. MISC. No.86496 of 2019(3) dt.19-03-2020 2/2 application for grant of bail to the petitioner submitted that from the hut of the petitioner, 171 liters of foreign liquor has been recovered.
Be that as it may, regard being had to the nature of allegation and the submissions made above, the petitioner is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Special Judge, Excise, Darbhanga in connection with Bahadurpur P.S. Case No. 169 of 2019.
