The petitioner apprehends his arrest in connection with Sasaram (Town) P.S. Case No. 1007 of 2018, registered under Sections 366A and 380/34 of the Indian Penal Code. The accusation is of kidnapping of Shahazadi Khatoon, daughter of the informant, Md. Pappu, by Raja Khan with the help of Sonu Khan, Rinu Khan, Lado Khatoon and Rehana Khatoon.

Learned counsel for the petitioner submits that, in fact, due to love affairs daughter of the informant left her parental house and performed the marriage with petitioner in Ahmadabad on 16 May, 2018, according to her own sweet will,

Patna High Court CR. MISC. No.3146 of 2020(2) dt.04-02-2020 2/2 which would appear from her statement recorded under Section 164 Cr.P.C., in which, she disclosed her age as 17 years. Further submission is that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Rohtas, Sasaram, in connection with Sasaram (Town) P.S. Case No. 1007 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
