JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-02-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Bhojpur Mahila P.S. Case No. 98 of 2019 registered for the offences punishable under Sections 341, 323, 307, 498A, 34 the Indian Penal Code.

Petitioner no. 1 is father-in-law, petitioner no. 2 is sister-in-law (Nanad), petitioner no. 3 is elder brother-in-law, petitioner no. 4 is sister-in-law (Jethani) and petitioner 5 is cousin father-in-law of the informant and general allegation of torture as well as demand of dowry has been levelled against

Moreover, the perusal of the written report of the informant goes to show that the entire allegation centers around of her husband. Furthermore, the written report of the informant goes to show that her husband had illicit relation with petitioner no. 4 and that was the reasons, she was thrown out from window, as a result whereof, she sustained fracture injury. However, the written report itself demonstrates that the aforesaid occurrence was taken place on 01.01.2019 and the written report was given on 05.06.2019.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that the petitioners, above named, in the event of their arrest/surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bhojpur at Ara in connection with Bhojpur Mahila P.S. Case No. 98 of 2019 subject to conditions as laid down under Section 438(2) of the CrPC.
