JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-02-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Dulhin Bazar P.S. Case No. 136 of 2018 registered for the offences punishable under Sections 304B of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act.

Petitioner happens to be husband of the deceased. Submission on behalf of the learned counsel appearing for the petitioner is that deceased consumed poison and as a matter of fact, she was never killed by the petitioner as well as his other family members. He further submits that when the informant came to know about the real fact, he entered into compromise which has been annexed as Annexure-2 to this petition.

No.87092 of 2019(2) dt.20-02-2020 2/2 Regard being had to the facts and circumstance as well as submission of the parties, I am not inclined to grant privilege of anticipatory bail to the petitioner in connection with Dulhin Bazar P.S.Case No. 136 of 2018, pending in the court of Additional Chief Judicial Magistrate, Danapur, Patna and accordingly, his prayer for anticipatory bail stands rejected.
