JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 24-06-2026 Earlier, the matter was referred to Mediation Centre, but the dispute between the parties could not be settled through the process of mediation and as such, mediation failed.

2. Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the O.P. No. 2.

3. The petitioner apprehends his arrest in a case registered under Section 498A of the Indian Penal Code.

4. The prosecution case, in brief, is that the marriage of the complainant with the petitioner was solemnized in the year 2023 as per Hindu rites and customs. After sometime of marriage, the petitioner and his family members started

Patna High Court CR. MISC. No.367 of 2026(3) dt.24-06-2026 2/3 demanding dowry and due to non-fulfillment of the same, the complainant was subjected to torture by her in-laws. On 05.12.2023, the accused persons ousted the complainant from matrimonial home.

5. Learned counsel appearing on behalf of the petitioner submits that the petitioner is the husband of the O.P. No. 2 and has falsely been implicated in the present case. Further submission is that petitioner and his family members have never demanded any dowry nor tortured the complainant. Further submission is that petitioner is always ready to keep the complainant with full honour and dignity but the complainant does not want to lead conjugal life with the petitioner. Petitioner is aged about 24 years having no criminal antecedent and he undertakes to cooperate in the investigation and trial.

6. Learned A.P.P. for the State and learned counsel for the O.P. No. 2 have opposed the bail application.

In view of the facts and circumstances of the case, submissions on behalf of the parties, nature of allegation levelled against the petitioner and his clean antecedent, in the event of arrest or surrender before the learned court concerned within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the
