There has been dacoity in the office of Courier Company wherein the dacoits took away Rs. 3,35,000/- from locker while petitioner, an employee was engaged in official work at the relevant time.
It is evident from para-4 of the case diary that petitioner was examined as a witness. It is further evident from para-13 that after CCTV Footage, two accused were identified to be Rahul Kumar and Ranjit Kumar. As per para-14, Rahul Kumar, Kishan Kanhaiya and Prashant were apprehended and from their possession fire arms, part of booty were also recovered. It is further evident from their inculpatory extra-judicial confessional statement that they had disclosed identity of other co-accused and
Patna High Court CR. MISC. No.4270 of 2020(3) dt.28-05-2020 2/2 in likewise manner, also shown complicity of the petitioner as an informer. However, it is not at all found substantiated by the corroborative evidence.
In the facts and circumstances of the case, petitioner, Raja Kumar is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in Jandaha PS Case No. 210/2019.
