The petitioner seeks bail in connection with Nayagaon P.S. Case No. 172 of 2019, registered under Sections 188, 272 and 273 of the Indian Penal Code and 30, 38 and 41 of the Bihar Prohibition and Excise Act, 2016.

The accusation is that when, the informant, along with other police personnel, reached at the railway crossing of Bariar Chak, one person was seen fleeing away from bush, seeing the police vehicle. On chase, he was apprehended, who disclosed his name Loknath Rai and on his disclosure 60 liters country made liquor, kept in a black tube, recovered from bush. Submission is that the petitioner has no criminal antecedent and is in custody since 23.11.2019. Having regard to the facts and circumstances of the
