ANJANA MISHRA ORAL ORDER 20-01-2020 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 02.12.2019 in connection with Manjhi P.S. Case No.198 of 2019 registered for the offence under Sections 30, 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the alleged recoveries were from beside the hotel of the present petitioner, but intentionally recovery has been saddled on the shoulders of the petitioner by showing that the recovery was from the petitioner's house. It is further submitted that the alleged recoveries were not in his presence and the petitioner has nothing to do with the same.

Considering the aforementioned facts and
