This application for regular bail arises out of Kursakanta (Sonamani Godam O.P.) P.S. Case No. 269 of 2019, disclosing offences punishable under Sections 341, 323, 354, 379, 494,498 (A), 307, 504 and 506 of the Indian Penal Code. The informant is the mother-in-law of the petitioner. It is alleged in the F.I.R. that the informant was accusing the petitioner of not taking due care of his wife and was not properly maintaining her. Allegedly the petitioner and his family members, in reaction, started assaulting the informant. There is allegation against the petitioner of having assaulted the informant with iron rod in her head. Learned counsel appearing on behalf of the petitioner has submitted that there is a counter case also for an occurrence said to have taken place on the same day.

Learned counsel appearing on behalf of the informant has opposed the prayer for regular bail.

However, considering the genesis of occurrence and the material collected in course of investigation, this application is allowed.

Let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-V, Araria in connection with Kursakanta (Sonamani Godam O.P.) P.S. Case No. 269 of 2019.
