JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-02-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Matihani P.S. Case No. 157 of 2019 registered for the offences punishable under Sections 379 and 143 of the Indian Penal Code and 27 of the Arms Act.

The accusation against the petitioners is that they made indiscriminate firing and took away the net of informant but submission on behalf of the petitioners is that the informant of the present case as well as others had put net on the agricultural field of the petitioner no. 1 and when he got information about the above stated act of informant of the

No.603 of 2020(2) dt.20-02-2020 2/2 present case, he went there but informant and his associates made indiscriminate firing and after that they lodged the present false case. He further submits that the empty cartridges were produced by the informant and, therefore, no case under section 27 of the Arms Act is made out. He further submits that petitioner no. 1 also lodged Matihani P.A.Case No. 158 of 2019 against the informant and his associates.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate1st class, Begusarai in Matihani P.S. Case No. 157 of 2019 subject to condition as laid down under Section 438(2) of the Cr.P.C.
