JUSTICE ANIL KUMAR SINHA ORAL ORDER 01-05-2023 Petitioner has sought a direction from this Court for appointment of the petitioner on compassionate ground pursuant to death of his mother namely, Late Punam Kumari in harness on 22.02.2017.

Learned counsel for the petitioner submits that petitioner has already submitted his application for appointment on compassionate ground pursuant to the Circular issued by the

Patna High Court CWJC No.1434 of 2020(3) dt.01-05-2023 2/2 State of Bihar, Education Department dated- 09.07.2021. He further submits that vide Annexue- 5 to the writ application the application form of the petitioner has duly been recommended by the competent authority. He next submits that District Compassionate Committee of the concerned district is the competent authority for taking decision regarding compassionate appointment.

Learned counsel for the State submits that direction may be issued to the District Compassionate Committee to take a decision upon the application / request of the petitioner for compassionate appointment within a reasonable time frame. Regard being had to the submission made by the parties and taking into consideration the nature of dispute, the present writ application is disposed with a direction to the District Compassionate Committee of District- Siwan to take a decision upon the application of the petitioner for compassionate appointment within a period of four months from the date of receipt / production of a copy of this order.
