JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-02-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Sitamarhi P.S. Case No. 249/19 registered for the offences punishable under Sections 341, 342, 323,324, 307, 379/34 of the Indian Penal Code.

Petitioner is said to have given dagger blow causing injury on the neck of the informant. The injury report of informant has been annexed as Annexure 2 to this petition which goes to show that the informant sustained incised wound measuring 1" x 1⁄4"x skin dip. However, after CT Scan, the aforesaid injury was found simple in nature said to be caused by sharp object.

Learned counsel appearing for the petitioner submits that the aforesaid injury is a manufactured injury and, moreover,

He also submits that so far as as allegation of snatching money is concerned, the same appears to be superficial. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that above named petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in Sitamarhi P.S. Case No. 249/2019 subject to conditions as laid down under Section 438(2) of the Cr.P.C.
