2. The petitioner has preferred this application for grant of regular bail in connection with Amarpur P.S. Case No. 796 of 2025 registered for the offences punishable under Section 96 of B.N.S. and later on Section 8/12 of POCSO Act has been added.
3. As per the prosecution case, this petitioner along with others is alleged to have kidnapped the minor daughter of the informant aged about 17 years. The informant apprehended that's any untoward incident may happen with the petitioner.

4. Learned counsel for the petitioner submits that as per the medical report, the victim is aged above 18 years. Moreover, in her statement recorded under Section 183 BNSS, she has not stated anything against the petitioner, she has stated that she was in love with this petitioner and she has clearly stated that there was no physical relationship with the petitioner. It has further been submitted that petitioner is in custody since 20.11.2025 having no criminal antecedent.
5. Learned A.P.P. for the State and learned counsel for the Opposite Party No.2 have vehemently opposed the prayer for bail of the petitioner and submitted that the victim appears to be a minor one.

Perused the record, considered the submissions of the parties and the facts and circumstance of the case, the petitioner above-named is directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Banka in connection with Amarpur P.S. Case No. 796 of 2025.
7. The petitioner is directed to co-operate in the trial and be well represented on each and every date fixed in the trial and failure to appear on two consecutive dates, the court below
Patna High Court CR. MISC. No.1728 of 2026(3) dt.07-04-2026 3/3 would be at liberty to cancel the bail bonds of the petitioner.
8. The application stands allowed.
