The petitioners seek bail in anticipation of his arrest in connection with Pakridayal P.S. Case No. 244/2019 dated 19.08.2019 instituted for the offences under Sections 341, 323, 307, 379, 504 and 34 of the Indian Penal Code.
Patna High Court CR. MISC. No.87070 of 2019(3) dt.24-06-2020 2/3 The petitioners are alleged to have assaulted the informant and his family members.
Learned counsel for the petitioners has drawn the attention of this Court to the fact that specific accusation of assault has been attributed to petitioner nos. 1 and 3, who are said to have assaulted the informant and his son respectively by means of lathi. The injuries suffered by them are stated to be simple in nature. There is a long standing dispute between the parties and they are also agnates.
Considering the afore-stated facts, the petitioners, above named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -V, Motihari, East Champaran, in
Patna High Court CR. MISC. No.87070 of 2019(3) dt.24-06-2020 3/3 connection with Pakridayal P.S. Case No. 244/2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
