2. Petitioner apprehends his arrest in a case registered for the offence punishable under section 109, 3(5) of the BNS and section 27 of the Arms Act.

3. As per the prosecution case, during the cricket match, when the winning team was being awarded by the Guest Anjani Singh, some unknown criminals opened indiscriminate firing at Anjani Singh due to which three persons Anjani Singh husband of Mukhiya, Kumari Rajani, Dharmendra Kumar and Vishwajeet Kumar were injured. After committing crime all the assailants fled away from the place of occurrence on Motorcycle. One of the criminal fled away leaving his motorcycle. 4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner is not named in the FIR and his name has been surfaced on the basis of confessional statement of another accused which carries no evidentary value. There is no specific allegation against the petitioner. It is further submitted that the petitioner has got no criminal antecedent as disclosed in Paragraph-3 of the application.

5. Learned A.P.P for the State and learned counsel for the informant opposes the prayer for anticipatory bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and also taking note of the fact that petitioner is not named in the FIR, I am inclined to grant privilege of anticipatory bail to the petitioner.

7. Let the petitioner, as named above, in the event of his arrest or surrender within four weeks from today, be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate-
