JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-05-2020 Heard learned counsel for the petitioners as well as learned A.P.P. for the State through video conferencing. This relates to grant of bail in Piro P.S. Case No. 302 of 2019, registered for the offence under Sections 147, 149, 379, 323, 341, 302 of the Indian Penal Code.

The prosecution case, as per F.I.R., is that the petitioners alongwith other eight accused persons assaulted the father of informant by lathi, danda, rod etc., as a result of which, he (father of informant) died on the spot.

It is submitted on behalf of petitioners that there is general and omnibus allegation and no specific overt act has

It is further submitted that petitioners are innocent and have committed no offence, but due to land dispute, they have falsely been implicated. In this case, chargesheet has already been submitted. Petitioners have no criminal antecedent and they are in custody since 29-10-2019. Considering the aforesaid facts and circumstances, the bail application is allowed.

Let the above-named petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur, Ara in connection with Piro P.S. Case No. 302 of 2019.
