JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-06-2020 The petitioner seeks bail in anticipation of his arrest in connection with Dhamdaha P. S. Case No. 120 of 2019 dated 24.04.2019 instituted for the offences under Sections 272, 273 and 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

There is recovery of 69.75 litres of liquor from the house of the petitioner. The petitioner has also been made accused earlier, which fact has been mentioned in paragraph 3 of the bail petition.

Considering the aforesaid factum of recovery of liquor from the house of the petitioner, this petition does

The prayer for anticipatory bail is rejected. In case the petitioner surrenders before the court below and seeks bail, the same shall be considered on its own merits, without being prejudiced by the fact that the present petition has not been entertained by this Court.
