Petitioners seek bail in a case registered for the offences punishable under Sections 30 and 30(a) of the Bihar Prohibition and Excise Act, 2016.
From the joint house of the petitioners about 549 litres of liquor was recovered. Petitioners have stated on oath that they have got no criminal antecedent. They are in custody since 11.12.2019. There is no material to substantiate that the petitioners are going to tamper with the evidence or abscond the process of law.
Considering the entire facts, let the petitioners, above named, be released on bail, after framing of the charges only so that the trial may not hamper, on furnishing bail bonds of
Patna High Court CR. MISC. No.1537 of 2020(2) dt.21-01-2020 2/2 Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Marhowrah Police Station Case No. 845 of 2019, subject to the following conditions:- (a) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioners.
(b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
The trial court is directed to expedite the framing of the charge against the petitioners.
