Heard Mr. Sachida Nand Rai, learned counsel for the petitioner and Mr. Sunil Kumar Pandey, learned Additional Public Prosecutor for the State.
Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273, 467, 468, 471, 414 of the Indian Penal Code, Sections 30, 30(a), 36, 38 and 41 of the Bihar Prohibition and Excise Act, 2016.
Recovery of liquor is alleged from a truck. The petitioner was also there, hence, he was apprehended on suspicion, though nothing was recovered from his physical possession. Petitioner has got no criminal antecedent. Petitioner is in custody since 11.12.2019. Investigation of the case is already complete against the petitioner.

No.86501 of 2019(4) dt.12-05-2020 2/2 Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Masrakh P.S. Case No. 535 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.
If the petitioner would not be comfortable in furnishing bail bond due to lock-down, he shall be provisionally released on his personal bond and the provisional bail shall be confirmed only after production of the bailors within fifteen days of restoration of normal function of the Court.
