JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 28-05-2020 This has been posted before me for hearing through videoconferencing, under the orders of Hon'ble the Chief Justice, in view of Nation passing through lockdown as an aftermath of the outbreak of COVID-19 pandemic.

Heard learned counsel for the petitioner, the informant and learned APP for the State.

The petitioner seeks bail in a case registered for the offence punishable under Sections 302, 201/34 of the Indian Penal Code. Allegation against the petitioner is that he killed the deceased by knife.

It has been submitted on behalf of the petitioner that the petitioner is son-in-law of informant and brother-in-law of deceased Anurag Kumar. The petitioner was married with the daughter of informant namely Kamini Kumari 15 years ago since then they are living peacefully without any complaint from any corner. Admittedly, FIR was lodged against unknown criminals but petitioner has been

No.285 of 2020(3) dt.28-05-2020 2/2 implicated subsequently in this case by the informant alongwith his brothers at the instance of persons of vested interest who have greedy eyes on the property of informant. It has been further submitted that the petitioner is quite innocent and had committed no offence he has been dragged in this case without any cogent and reliable material; except suspicion there is no material which any how connect the petitioner without the present occurrence. There is no eye witnesses to the alleged occurrence. The petitioner is in custody since 13.09.2019 and has got no criminal antecedent. There is no specific allegation against the petitioner and there is no eye witnesses to the alleged occurrence, but only on suspicion the petitioner has been made accused in this case.

Considering the entire facts of this case and nature of material against the petitioner, let the petitioner, above named, be released on bail only after framing of charge against the petitioner, on furnishing bail bond of Rs. 20,000/- (rupees twenty thousand) with two sureties of the like amount each in connection with Surajgarha P.S. Case No. 186 of 2019 (G.R. No. 1286 of 2019 to the satisfaction of the learned C.J.M., Lakhisarai.
