JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-02-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Samastipur P.S. Case No. 195 of 2019 registered for the offences punishable under Sections 120B, 307, 326, 447 of the Indian Penal Code.

Petitioners are named in the first information report but only suspicion has been raised against them and according to fardbeyan of the informant itself, three unknown persons had opened fire on him.

Submission on behalf of the petitioners is that petitioner no.1 is step mother, petitioner no.3 is step brother

Patna High Court CR. MISC. No.87089 of 2019(2) dt.20-02-2020 2/2 whereas petitioner no. 2 is father of the informant and the informant raised his suspicion against the petitioners on account of family dispute.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that the above named, petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrat-V, Samastipur in Samastipur Muffasil P.S. Case No. 195 of 2019 subject to condition as laid down under Section 438(2) of the Cr.P.C.
