JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2020 This is an application for grant of anticipatory bail in connection with Excise Case No. 67C3Ex of 2010 disclosing offence under Section 47 (A) of the Bihar Prohibition and Excise Act.

As per complaint case, there is recovery of 435 liters of country made liquor made from the house of one Mithlesh Singh and the name of the petitioner transpires on suspicion as an associate.

Submission of the learned counsel for the petitioner is that except suspicion, there is nothing against him. No recovery is made from his house or at his instance. He has no criminal antecedent.

Having heard both sides, considering the above

Patna High Court CR. MISC. No.87127 of 2019(2) dt.23-01-2020 2/2 submissions, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise, Nalanda, Biharsharif, in connection with Excise Case No. 67C3Ex of 2010.
