JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-02-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Gopalganj Town P.S. Case No. 478 of 2019 registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.

The only allegation against petitioner no. 1 is that he gave order to others whereas there is specific allegation of assault against petitioners no. 2 and 3. Furthermore, the informant claims that petitioners no. 2 and 3 also outraged the modesty of his young daughter.

No.86960 of 2019(2) dt.14-02-2020 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, prayer for anticipatory bail of petitioner no. 1, namely, Lalji Sah is allowed and accordingly, it is ordered that petitioner no. 1, namely, Lalji Sah, in the event of his arrest/ surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in Gopalganj Town P.S. Case No. 478 of 2019, subject to conditions as laid down under Section 438(2) of the Cr.P.C.

So far as prayer for anticipatory bail of petitioner no. 2, namely, Ankush Sah and petitioner no. 3, namely, Pappu Sah @ Papp Sah is concerned, the same stands rejected. (Hemant Kumar Srivastava, J) shahzad/- U T
