JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-02-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Barauli (Madhopur O.P.) P.S. Case No. 70/2019 registered for the offence punishable under Sections 341, 323, 376, 302 and 420 of the Indian Penal Code.

Petitioners happen to be parents-in-law of the informant and the first information report (complaint petition) goes to show that entire allegation of rape centres around coaccused Rajesh Mahto and, similarly, the accusation of murder of informant's husband centres around co-accused Rajesh Mahto and co-accused Dinesh Mahto and so far as the petitioners are concerned, no overt act has been attributed

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that above named petitioners, in the event of their arrest/ surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate XIV, Gopalganj/concerned court in Barauli (Madhopur O.P.) P.S. Case No. 70/2019 subject to conditions as laid down under Section 438(2) of the Cr.P.C.
