JUSTICE RAJESH KUMAR VERMA ORAL ORDER 09-04-2026 Heard Mr. Alok Kumar Alok, learned counsel for the petitioner, Mr. Ram Priya Sharan Singh, learned A.P.P. for the State and Mr. Ravish Mishra, learned counsel for the Informant.
2. The petitioner seeks bail, who is in custody since 10.10.2025 in connection with Industrial Area P.S. Case No. 102 of 2025, FIR dated 19.07.2025 registered for the offence under Section 126(2), 115(2), 118, 318(4), 64, 351(2), 3(5) of the Bharatiya Nyay Sanhita, 2023.
3. According to the prosecution case, the informant claims that her husband worked with the petitioner due to which, the petitioner used to come to her house. In the year
Patna High Court CR. MISC. No. 1844 of 2026(4) dt.09-04-2026 2/3 2023, in absence of her husband, he kept sexually exploiting her by threatening to kill her son and also took Rs.2 Lakh from her by threatening to make her obscene video viral. On 01.07.2025, the petitioner along with other co-accused persons came to her house and took her husband away from the house on pretext of talking to him. Thereafter, he entered his house and beat the informant with intention of aborting her pregnancy.
4. Learned counsel appearing for the petitioner submits that the petitioner has clean antecedent and he has falsely been implicated in this case. He further submits that the allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offences as alleged in the F.I.R. and the petitioner is rotting in judicial custody since 10.10.2025.

Learned A.P.P. for the State as well as learned counsel for the Informant, on the other hand, have vehemently opposed the prayer for bail of the petitioner and submits that the victim in her statement recorded under Section 183 BNSS has fully supported the case of the prosecution and apart from that medical report of the victim suggest that she is pregnant.
6. Considering the facts and circumstances of the case and nature of allegation and statement of the victim which
Patna High Court CR. MISC. No. 1844 of 2026(4) dt.09-04-2026 3/3 is supported by medical evidence, I am not inclined to enlarge the petitioner on bail in connection with Industrial Area P.S. Case No. 102 of 2025, pending in the Court of C.J.M., Vaishali, Hajipur.
7. Prayer is refused.
