2. The petitioner seeks bail, who is in custody since 09.06.2025 in connection with Jagdishpur P.S. Case No. 73 of 2025, FIR dated 22.02.2025 registered for the offence under Section 140(3), 140(1), 103(1), 238, 318(4), 338, 336(3), 61(2), 3(5) of the Bharatiya Nyay Sanhita, 2023 and 66(B), 66©, 66(D) of the I.T Act.

3. According to the prosecution case, the informant alleged that on 17.02.2025, his son went to Patna by train to meet his friend but didn't return and on search, no trace of him was found.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. Petitioner is not named in the FIR and his

Patna High Court CR. MISC. No.2248 of 2026(3) dt.09-04-2026 2/2 name transpired during investigation on the basis of confessional statement of co-accused, namely, Shambhu Kumar and the petitioner is rotting in judicial custody since 09.06.2025.

Learned A.P.P. for the State has vehemently opposed the prayer for bail of the petitioner and submits that the said Shambhu Kumar has confessed his guilt which was recorded in paragraph no.47 of case diary in which he had categorically stated that he along with the petitioner and other co-accused persons killed informant's son and thereafter thrown the body of the deceased in river Ganga near Jamuniya and apart from that petitioner had also confessed his guilt in the present occurrence. He further submits that petitioner carries eight criminal antecedents other than the present one in which he is on bail in all cases.

6. Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail in connection with Jagdishpur P.S. Case No. 73 of 2025, pending in the Court of Additional Sessions Judge-VII, Bhojpur, Ara.

7. Prayer is refused.
