The present writ petition has been filed seeking relief for a direction to the respondents to consider the case of the petitioner for regularization in the contingency establishment w.e.f. 28/08/2005. The respondents while filing reply produced the documents dated 20/08/2008, where by it has been ordered that the services of the petitioner has since been regularized w.e.f. 19/08/2008. While passing the said order the State has also mentioned that the benefit could not be extended to the petitioner with effect from the year 2005 for the reason of non availability of sanctioned vacant post .

Given the facts that the petitioner now has been regularized with effect from 2008, this Court is of the opinion that the matter has rendered infructuous and the writ petition accordingly stands disposed off reserving the right of the petitioner to reagitate, in case, any other grievance which, if survives.
