For Non-Applicant : Shri Anshuman Shrivastava, Panel Lawyer. Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 10/03/2021 :

1. The applicant has preferred this application for grant of anticipatory bail as he apprehends his arrest in connection with Crime No.339/2020, registered at Police Station Chakardhar Nagar, District Raigarh for offence punishable under Section 327 of the IPC.

2. The applicant demanded money from the complainant Tushar Singh Rajput for consuming liquor and on refusal, he was assaulted with club causing simple injuries.

3. Learned State Counsel would oppose the prayer for grant of anticipatory bail. However, he would submit that the concerned SHO has not reported registration of any previous offence against the applicant.

4. Considering the nature of offence and for the fact that the applicant is the first offender, I am inclined to extend the benefit of anticipatory bail

MCRCA 5/2021 to the applicant.

5. Accordingly, the Application is allowed and it is directed that in the event of arrest of the applicant, he shall be released on anticipatory bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the arresting officer with the following conditions:- (i) he shall not influence the witnesses during trial. (ii) he shall make himself available for interrogation by a police officer as and when required;

(iii) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.
