Hon'ble Shri Justice P. Sam Koshy Order On Board 09.10.2018 The claim of the petitioners is for grant of regularization. The matter is pending consideration before this Court for the last 8 years. 2.

Counsel for the petitioner submits that the Secretary of the Department has already issued instruction in this regard permitting the petitioners to be regularized. However, till date no formal order has been passed.

Given the aforesaid factual matrix of the case, this Court does not

intend to keep the petition pending, rather ends of justice would meet if respondent no.1 is directed to take an appropriate decision in the case of the petitioners seeking for regularization in service in accordance with the rules and regulations and the instruction that respondent No.1 had on an earlier occasion passed.

Let this exercise be completed within a period of 4 months from the date of receipt of certified copy of this order. 4.

It is made clear that this Court has not expressed any opinion on the merits of the case and the authority concerned would be at liberty to take a decision independently.
