By this first appeal under Section 96 of the Code of Civil Procedure, the appellant has challenged the illegality and propriety of judgment and decree dated 10.01.1997 passed by First Additional District Judge, Rajnandgaon, [MP (now State of CG)]in Civil Suit No.5A/1991.

The case is listed for final hearing in the weekly list commencing from 09.7.18 to 13.7.18. The case was called on every day of the week, but none appeared to represent the appellant.

In absence of any representation on behalf of the appellant, this Court has left with no other option but to dismiss the matter for want of prosecution.

Consequently, the appeal is dismissed for want of prosecution.

No order as to cost.
