1. The challenge in the present writ petition was in respect of non-granting of appointment to the petitioner on the post of Shiksha Karmi Grade-III in the recruitment process initiated in the year 2008. The non-granting of appointment to the petitioner was in accordance with the then prevailing rules of the candidates having three children and third children having born after 21.01.2001.

2. Pending the petition, there appears to be a development to the extent that the said disqualification, which was prescribed under the Act has been omitted by the State Government.

3. Given the aforesaid development, without entering into the merits of the case, the present writ petition stands simply disposed off directing the petitioner to move an appropriate representation before the department

ventilating his grievance in the light of the omission of the rules by the State Government. On such representation being made, the respondent no.3 concerned would be free to take a decision in accordance with the rules and regulations governing the field.

4. With the aforesaid observations, the present writ petition stands disposed off.
