Grievance of the petitioner is that the petitioner was appointed on compassionate ground by order dated 1/01/2016. Appointment of the petitioner was subsequently cancelled by the Chief Executive Officer in the month of June, 2016 which was subject of challenge before the Commissioner, Sarguja. It is contended that though the appeal was filed in 2016 same is not being adjudicated till date and the respondent/Commissioner may be directed to decide the appeal of the petitioner within a stipulated time.

Perusal of the record would show that the petitioner was appointed on the compassionate ground in 2016 and subsequently services of the petitioner were annulled which was subject of appeal before the Commissioner. Order sheet would show that appeal was filed. Considering the order sheet, issue pertains to compassionate appointment and subsequently appointment having been cancelled which is subject of

appeal before the Commissioner. Prima facie considerable delay has occurred. In view of this, respondent No.2, Commissioner is directed to decide appeal of the petitioner within a period of 60 days from the date of receipt of this order.
