This is the second bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.240/2017 registered at Police Station- Nandini Nagar, District Durg (C.G.) for the offence punishable under Section 376 of Indian Penal Code & Section 4, 6 of Protection of Children from Sexual Offices Act.

The first bail application was dismissed as withdrawn on 14.05.2018 with liberty to repeat the same after examination of the prosecutrix.

As reported, the prosecutrix has not still been examined till today, therefore, the liberty which was given by the order dated 14.05.2018 is yet to be achieved. The instant bail application is premature and accordingly it is dismissed.
