1. In the present case, prayer for grant of leave to appeal has been made on the submission that even though no crime was committed by the complainant, the State authorities lodged a false case against him which led to registration of offence.

2. After going through the order passed by the Magistrate, we find that against the complainant, criminal case is already pending in the Court and it is not a case where he has been acquitted of the charges.

3. Learned counsel for the petitioner, during the course of argument, disclosed

-2 that charges have already been framed.

4. Therefore, at this stage, we are not inclined to grant any leave to appeal.

5. The petition is accordingly dismissed.
