Hon'ble Justice Shri Gautam Chourdiya 28/11/2019 Judgment On Board 1) This appeal is filed under section 374(2) of Code of Criminal Procedure, 1973 against the judgment of conviction and order of sentence dated 30/10/1999 passed by Additional Session Judge, Sakti, District Bilaspur (M.P.) now (C.G.) in Session Trial No. 109/99; whereby the appellant stands convicted and sentenced as under:- Conviction Sentences U/s. 307 of Indian Penal Code (in short "IPC") R.I. for 3 years & fine of Rs.
1,000/- in default of fine additional R.I. for 3 months.
2) This Court vide order dated 24/10/2019 had directed both the counsels to ascertain whether the appellant is alive or not. 3) Learned counsel for the State submits that in compliance of the order, a letter was written to the Superintending of Police, Janjgir-Champa for verifying the fact whether the appellant is still alive or not and pursuant thereto, the concerned Station House
Officer, Police Station Baradwar, District Janjgir-Champa has submitted a report alongwith death certificate of the appellant according to which the appellant died on 01/08/2019. 4) Copy of aforesaid documents are taken on record and the originals are returned to the State counsel.
5) In view of the fact that the appellant has died on 01/08/2003, the present appeal stands disposed of having abated. -Sd/- (Gautam Chourdiya) Judge Chandrakant
