Considering the submission of learned State counsel and the caused shown in the application, delay is condoned. 3.

Taking into consideration that despite recovery of human blood stained clothes of the accused and the weapon used in commission of offence at the instance of the appellant, disclosure statement proved by evidence of Investigating Officer and independent witness, acquittal has been ordered, we are inclined to grant leave to appeal. Application is allowed.
