The applicant has preferred first bail application filed under Section 439 of the Cr.P.C for grant of regular bail as he is arrested in connection with Crime No. 142/2017 registered at Police StationTelibanda Raipur (C.G.) for the offence punishable under Section 420 read with Section 34 of IPC.

It is alleged that present applicant along her husband made a fraud with the complainant. They showing themselves as Directors of the ARB Real Buildcon Promoter Pvt. Ltd., encouraged the complainant to book a plot and taken Rs. 8,60,000/- by cheating. Later on, when the complainant made a contact to these persons, they did not offer any

response. He, then, contacted to ARB Real Builcon Promoter Pvt. Ltd. office and found that the applicants were not authorized for booking of the said plot by the ARB.

Learned counsel appearing on behalf of the applicant submits that the applicant is innocence and has been falsely implicated in the present case. She did not make any fraud with the complainant and even there was no talk took place between the complainant and her. Also she has not taken any amount from him. It is further submitted that charge-sheet has been filed, the applicant is in jail since 18/11/2017 and she is a lady, therefore, she may be released on bail. 5.

Per contra, learned counsel appearing on behalf of the State opposes the bail application.

I have heard learned counsel for both the parties. 7.

Considering the facts and circumstances of the case, particularly considering the fact that the charge-sheet has already been filed, the applicant is in jail since 18/11/2017, without commenting on merit of this case, this court is inclined to release the applicant on bail. 8.

Accordingly, MCRC. No. 554/2018 is allowed. It is directed that the applicant shall be released on bail on executing a personal bond for a sum of Rs. 40,000/- with two sureties (each of Rs. 20,000/-) for the like amount to the satisfaction of the trial Court. Thereafter, she will appear before the Trial Court on each and every date given by the said Court. Sd/- Judge Arvind Singh Chandel Rahul
