1. This appeal arises out of the judgment of conviction and order of sentence dated 29.06.2015, passed by the 5th Additional Sessions Judge, Bilaspur in S. T. No. 02/2015, whereby the appellant stand convicted under Section 302 of Indian Penal Code and sentenced to life imprisonment with fine of Rs. 1,000/-, in default of payment of fine, to further undergo rigorous imprisonment

for one year.

2. A report has been received from Superintendent of Police, Central Jail Bilaspur informing that the sole appellant- Rajendra @ Dev Prasad Bargah Son of Shriram Bargah has died during incarceration on 31.08.2019.

3. The legal heirs/dependents of the sole appellant have not moved any application seeking permission to prosecute the appeal.

4. In the above circumstances, the instant Criminal appeal has abated. Accordingly, the Criminal appeal No. 1138 of 2015 is dismissed as abated.
