Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 22/01/2021 Heard.

1. The applicant has moved this application for grant of bail as he is arrested in connection with Crime No.30/2020 registered at Police Station- Mahila Thana, District : Raipur, C.G. for the offence under Sections 376 & 506 of IPC as per the challan.

2. Repeat bail application has been filed in exercise of liberty granted by this Court while rejecting first bail application vide order dated 27.08.2020.

3. Learned counsel for the applicant would submit that till date, trial has not been concluded. This Court had granted liberty to revive in case there is no likelihood of resumption of trial within three months.

4. This Court takes judicial notice of the fact that the physical functioning of the trial Court has started from 17.11.2020. Therefore, in that view of the matter, at this stage, I am not inclined to entertain this bail application. However, it will be open for the applicant to revive, in case of undue delay in trial, at an appropriate stage.
